Moved to Another State? Have Your Estate Plan Reviewed.

I have written previously about the ‘triggers’ that make it wise to review your Estate Plan. Some of the big life events that require a review are marriage, divorce, births and death. But moving from one state to another also can affect the goals/objectives/outcome of certain features of your Estate Plan.

It is advisable, when relocating, to have your documents reviewed by a LOCAL wills/trust/estate planning attorney in your new state. Why is this worth the effort? Although all of the legal documents themselves may not require any significant changes, each state has its own laws governing how certain provisions of the documents might be interpreted and treated.

As a simple example, as part of your Estate Plan you have the healthcare/medical Power of Attorney, and it is legally correct and drafted in the advised format of your former state. However, a health care provider in your new state may be reluctant to accept the document if anything should happen to you. The reason for this – the document is not drafted in the precise format and legal language of that particular state.

Because your Estate Plan governs so many aspects of your future wishes it is well worth the effort to make sure that each document within the plan meets every state requirement.
